Nobs Terms of Service

Agreement

These Terms are an agreement between you and Kyle McGahey, an individual trading as Nobs Cribbage (“Nobs,” “we,” or “us”), 504 Beacon Street, Boston, Massachusetts 02115, USA.

By creating or using a linked account, or by purchasing a Nobs Pro offer, you agree to these Terms and the Community Standards. The Privacy Policy explains how we handle personal data; agreeing to these Terms is not blanket consent to every data practice.

Who may use Nobs

You may play the local solo game without an account. Social and cloud features—including a linked account, username, friends, challenges, online games, cloud sync, and notifications—are available only to people age 13 or older, or the higher minimum age required where you live. By creating an account, you confirm that you meet this minimum age requirement.

You may use social features only if you can legally enter this agreement where you live. If you are not legally an adult, a parent or guardian may need to permit your use where local law requires it. Nobs does not offer a parental-consent account flow. Do not misstate your age or bypass an age restriction.

Where Apple or Google provides a privacy-preserving age signal, Nobs may rely on it where required by law, and may restrict or suspend online access when a signal establishes that you do not meet the minimum age. Nobs never asks for a birth date.

Accounts and security

A linked account uses Sign in with Apple or Google Sign-In through Firebase. Keep your provider account secure and follow its terms. Nobs does not receive or store your Apple or Google password.

After signing in, you may explicitly connect the other provider to the same Nobs account using a fresh provider authorization. Nobs does not silently merge or switch accounts when that provider credential already belongs to another Firebase account.

You are responsible for activity you knowingly authorize. Tell us promptly at support@nobscribbage.com if you believe someone else accessed your account. We may ask you to sign in again before a sensitive action such as deletion.

Your Nobs username does not need to be your real name. Profiles use a bundled preset avatar; Nobs does not accept custom profile images.

Permission to use the app

Nobs gives you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the app for lawful, non-commercial play, subject to these Terms.

Except where applicable law allows it, you may not copy, sell, rent, distribute, modify, reverse engineer, bypass security or access controls, scrape the service, or use Nobs code, artwork, audio, text, or game analysis outside the app without permission. Nobs and its licensors keep all rights in the app and its content.

Your username, reports, and feedback

You keep any rights you have in text you submit. You give Nobs a limited, worldwide, royalty-free license to host, display, copy, and process that text only as reasonably needed to provide the requested social feature, review and enforce reports, protect safety and security, meet legal duties, or handle legal claims. The license ends when the text is no longer needed for those purposes, subject to the Privacy Policy.

You must have the right to submit the text. Do not use a username or report note to reveal private information, infringe rights, make a knowingly false accusation, or submit illegal or abusive material. If you voluntarily send product feedback, Nobs may use it without payment or an obligation to adopt it.

Fair play and acceptable use

Follow the rules of cribbage and the Community Standards. Do not:

• harass, threaten, bully, hatefully target, sexually exploit, impersonate, or expose private information about another person;
• cheat, collude, manipulate a result or record, use unauthorized automation or a modified client, exploit a bug for an unfair advantage, or intentionally disrupt or stall a game;
• spam friend requests or challenges, evade a restriction, interfere with moderation, probe or overload the service, seek unauthorized access, or use Nobs for unlawful activity.

No gambling or prizes

Nobs is an entertainment card game. It does not currently offer cash prizes, wagering, virtual currency, loot boxes, or items with cash value. Do not use the app to organize gambling, wagering, or a contest for money or anything of value.

Scores, records, grades, achievements, and other in-app results have no monetary value.

Nobs Pro purchases

Nobs Pro is an optional paid upgrade purchased through Apple’s App Store or Google Play. Nobs may offer it as a one-time purchase, an auto-renewing subscription, or both. The purchase screen identifies the offer you are buying and shows its store-local price, included features, and, for a subscription, its billing period and renewal terms. Payment is charged to your Apple or Google account. Apple and Google control billing, payment methods, and receipts; Nobs receives transaction and entitlement records but never your full payment-card or bank-account details.

A lifetime Nobs Pro entitlement sold as a one-time purchase remains a lifetime entitlement. A later change to the offers available for sale will not convert that purchase into a subscription or add a recurring charge. A refund, chargeback, store revocation, fraud, or closure of the Nobs service may end access.

By purchasing Nobs Pro—with or without a linked Nobs account—you agree to these Terms. A purchase made while playing as a guest belongs to your Apple or Google account and may attach to the Nobs account later used on that device or store account. Restoring purchases can reattach an entitlement, including after a Nobs account is deleted.

Refunds are handled by your store: request a refund from Apple or Google, which decides it under its policies and applicable law. Deleting your Nobs account does not refund a one-time purchase or remove it from your store account. Nothing in this section limits mandatory consumer rights, including any statutory withdrawal or refund right where you live.

If you buy an auto-renewing subscription, it renews and is charged to your Apple or Google account at the price and interval shown at purchase until you cancel it in your store’s subscription settings. Deleting your Nobs account or uninstalling the app does not cancel a subscription. If a subscription price changes, your store notifies you and, where required, asks for your consent before the change applies.

If Nobs Pro features materially change or are discontinued, the Changes and availability section applies.

Social features, reports, and blocking

Eligible players can choose a username and preset avatar, add or block players, send friend requests and challenges, and play online. There is no free-text chat or user-uploaded media in the current service.

You can report a username or behavior and block another player. Reports must be made in good faith and include only what is reasonably needed. Nobs reviews reports in context; report count alone does not decide enforcement.

A Nobs report is not an emergency service. If someone may be in immediate danger, contact the appropriate local emergency service.

Enforcement, appeals, and termination

We may reject or remove a username, warn an account holder, limit social features, suspend an account, or ban an account when reasonably needed to enforce these Terms or the Community Standards, protect people or the service, comply with law, or address security or fraud.

We will consider the nature, context, severity, and history of the issue and will act proportionately where practical. Serious or urgent harm may require immediate action. When appropriate, we will identify the rule and action and provide an appeal route in the app or through support@nobscribbage.com.

You may stop using Nobs at any time. A linked account can be deleted from Settings or with the instructions at https://www.nobscribbage.com/delete-account.

What deletion does

Deleting a linked account starts deletion of private profile, social, cloud-solo, preference, and Nobs/Firebase sign-in records. Pending challenges are canceled and an active online game may be forfeited.

Limited shared game, safety, moderation, and deletion-job records may remain as described in the Privacy Policy. Deleting a linked account does not automatically erase separate guest data on a device or information Apple or Google controls for its own services. Deleting an account also does not refund a one-time Nobs Pro purchase or cancel an active store subscription; see Nobs Pro purchases.

Changes and availability

We may update, add, remove, suspend, or discontinue features for maintenance, security, legal, operational, or product reasons. We do not promise that social or cloud features will always be available or error-free. Local data can be lost if app or device data is deleted, damaged, or unavailable.

We may change these Terms or the Community Standards for legal, security, operational, or product reasons. A change that is not material, such as a clarification or a formatting fix, may take effect when posted with an updated version and date.

For a material change we will give conspicuous notice in the app, normally at least 30 days before the new version takes effect, identifying the version, its effective date, and a summary of what changed. Continuing to use social or cloud features after the effective date means you accept the new version. If you do not agree, you can stop using those features or delete your account before that date, and the prior version applies until then.

If we ever add or materially change a dispute-resolution term, such as an arbitration agreement or a class-action waiver, that change will bind you only if you expressly agree to it.

Notifications

If you allow notifications, Nobs may send service messages such as friend requests, challenges, game-turn updates, results, or moderation notices. Delivery is not guaranteed.

Nobs does not currently send promotional push notifications. You can change service-notification categories in Nobs settings, and those choices are enforced before delivery. Device settings can stop all delivery.

Third-party stores and services

Nobs relies on Apple, Google, Firebase, Railway hosting, and email providers. Your use of an app store, device, sign-in provider, or other third-party service is also subject to that provider’s terms and privacy notice.

On Apple platforms, Apple’s standard Licensed Application End User License Agreement also applies where required. Nobs remains responsible for the Nobs app and support, subject to rights that applicable law does not allow us to limit.

Privacy

The Privacy Policy at https://www.nobscribbage.com/privacy explains what data Nobs and its current service providers process, why it is used, how long it is kept, and the choices and rights available to you. It is a notice, not bundled consent to optional processing.

Disclaimers and limits

To the fullest extent applicable law allows, Nobs is provided “as is” and “as available.” We do not promise uninterrupted or error-free operation. Nothing in these Terms excludes any warranty, guarantee, remedy, liability, or other right that cannot lawfully be excluded or limited.

To the fullest extent applicable law allows, Nobs is not liable for indirect, incidental, special, exemplary, or consequential losses arising from the app, and Nobs’ total liability for all claims relating to the app is limited to the greater of fifty US dollars or the amounts you paid for Nobs Pro in the twelve months before the claim arose. Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded.

Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules, except that you keep the protection of any mandatory law that applies where you live.

Subject to those mandatory rights, disputes may be brought in the appropriate state or federal courts in Massachusetts. If applicable consumer law gives you the right to bring a claim in another court, these Terms do not take that right away. These Terms contain no mandatory arbitration agreement or class-action waiver.

Other terms and contact

If a court finds part of these Terms unenforceable, the rest remains effective to the extent permitted by law. A delay in enforcing a term is not a waiver. These Terms and the Community Standards govern use of Nobs; the Privacy Policy separately explains data practices.
